The conference was attended by more than 400 people, which included academics, government officials, practitioners, development partners and forced migrants themselves, and explored key dimensions of the relationship between forms and tools of governance on one hand and patterns and experiences of forced migration on the other.

In mijn training lag de nadruk op de herziende asielprocedure in Nederland, en de rollen van, en de verhouding tussen, VluchtelingenWerk Nederland en de asieladvocatuur. Ook was er uitgebreid aandacht voor de organisatie van het systeem van gefinancierde rechtshulp in Nederland aan asielzoekers middels de Raad voor Rechtsbijstand.

Korte situatieschets Turkije- Asiel

Geografische beperking

Turkije heeft het Vluchtelingenverdrag wel ondertekend maar met een zogenaamde geografische beperking, hetgeen inhoudt dat Turkije alleen vluchtelingen erkent die afkomstig zijn uit een land dat lid is van de Raad van Europa (een beperking die het overgrote deel van de ondertekenaars al met het Protocol van New York uit 1967 hebben opgeheven). Er zijn geen plannen om deze geografische beperking op korte termijn op te heffen – het land grenst immers aan onder andere Iran, Irak en Syrië – al is deze eis wel onderdeel van een eventuele toetreding van Turkije tot de EU. Indien de geografische beperking al zal worden opgegeven zal ongetwijfeld door Turkije om garanties gevraagd worden in de vorm van ‘burdensharing’ met andere Europese landen.

UNHCR Turkije

De UNHCR is in Turkije verantwoordelijk voor de Refugee Status Determination voor niet-Europese vluchtelingen, en Turkije kent nu een ‘dual procedure’: De UNHCR beslist over de asielaanvraag, en de regering besluit of iemand die vluchteling is volgens de UNHCR tijdelijk in Turkije mag verblijven, totdat de UNHCR een hervestigingsplaats (resettlement) voor de vluchteling heeft gevonden. De Turkse regering volgt in zijn algemeenheid het oordeel van de UNHCR. Het acceptatiepercentage door de UNHCR is redelijk hoog, zo’n 70% van de geregistreerde aanvragen komen in  aanmerking voor de tijdelijke bescherming.

Hoewel de UNHCR een eigen mandaat heeft en ook op andere gronden tot een vorm van verblijfsaanvaarding kan besluiten, komen voor ‘resettlement’ in principe alleen ‘Verdragsvluchtelingen’ in aanmerking. in 2010 waren er 6.800 submissions en uiteindelijk 4.000 vluchtelingen die daadwerkelijk hervestigd zijn, met name in de VS, Canada en Australië. De UNHCR kijkt ook steeds meer naar het integratie-vraagstuk, nu asielzoekers/vluchtelingen steeds langer in Turkije verblijven (aangezien de aantallen stijgen duurt het langer voordat vluchtelingen kunnen worden hervestigd). De UNHCR heeft geen formele rechtsbasis voor haar werk in Turkije, ze werken op basis van een ‘gentlemen’s agreement’.

Satellietsteden

De mensen die in Turkije een asielaanvraag weten in te dienen moeten , na registratie, naar een van de zogenaamde ‘satellietsteden’ gaan, alwaar ze moeten verblijven – geheel op eigen kosten en zonder voorzieningen. Op dit moment zijn er ruim 30 satellietsteden, meestal in de Turkse binnenlanden, maar dit aantal zal (binnenkort) worden uitgebreid naar rond de 50, en wellicht op de middellange termijn zelfs naar rond de 80 (in elke provincie één). Ook als asielzoekers door de UNHCR erkend worden, en van de Turkse regering tijdelijke bescherming krijgen, moeten ze verblijven in deze satellietsteden. Elke 6 maanden moeten er hoge kosten betaald worden voor het verlengen van de verblijfsvergunning. De meeste asielzoekers in Turkije komen uit Irak, Iran, Afghanistan en Somalië. Daarnaast is Turkije voornamelijk een groot transitland voor vreemdelingen die zich niet bij de Turkse autoriteiten melden en op weg zijn naar Europa. Ook wel geregistreerde asielzoekers, en zelfs in Turkije (tijdelijk) erkende asielzoekers reizen soms nog door naar Europa.

Opvangcentra voor asielzoekers

De Nederlandse regering ondersteunt nu in een EU-gefinancierd Twinning project Turkije bij het opzetten van zeven Opvangcentra. Deze opvangcentra zullen plaats bieden aan 750 personen per centrum, in totaal dus aan ruim 5.000 personen. De jaarlijkse instroom ligt rond de 10.000 (geregistreerde) asielzoekers, dus de opvangcentra zullen niet genoeg plek hebben om allen onderdak te bieden. Hoe dit opgelost zal gaan worden is nu nog onduidelijk, en dat geldt ook voor de vele andere vragen (hoe zullen de centra worden geleid, wie gaat het precies betalen, wat voor voorzieningen komen er etc.).

HCA is een grote, onafhankelijke mensenrechtenorganisatie in Turkije en als enige Turkse organisatie lid van ECRE, the European Council on Refugees and Exiles. Binnen het HCA vormt het RASP (Refugee Support Advocacy & Support) een min of meer autonoom onderdeel. Het Matra-project van 3R heeft het RASP een grote boost gegeven, door de financiering voor drie jaar veilig te stellen. Dit project loopt eind maart 2012 af. HCA opereert alleen van Istanbul, heeft slechts enkele betaalde krachten, en werkt veel met ‘Fellows’ uit Amerika, studenten/vrijwilligers met een beurs, dan wel stagiairs uit Turkije zelf. Ook worden er enkele Turkse advocaten ’opgeleid’. De voertaal op het kantoor van HCA is primair het Engels.

HCA richt zich voornamelijk op het verlenen van (rechts)bijstand in beroepsprocedures tegen de UNHCR en op het EHRM. De organisatie heeft de laatste jaren een groot aantal interim-measures weten te krijgen voor haar cliënten wanneer het ging om aspecten zoals het krijgen van toegang tot de asielprocedure, het voorkomen van uitzettingen naar landen van herkomst en art. 5 EVRM aspecten (arbitraire detentie en detentieomstandigheden). HCA heeft zich ook steeds meer een positie verworven in het (politieke) speelveld in Turkije en wil met nadruk geen UNHCR-implementing partner worden om zo hun onafhankelijke positie vis-à-vis de UNHCR te kunnen behouden. Samen met 6 andere mensenrechtenorganisaties is in 2010 de CRR (Coordination for Refugee Rights) opgericht om zo hun krachten te bundelen en om meer met 1 stem te spreken. HCA wordt ook door de UNHCR gezien als een sterke speler in het veld, als een waakhond, maar met als nadeel dat zij erg klein zijn en slechts kunnen beschikking over de diensten van nog geen handjevol asieladvocaten in Turkije.

After years and sometimes even decades of living in tightly ordered Internally Displaced Persons camps, hundreds of thousands of IDPS have in recent years returned to their areas of origin in northern Uganda. But have they been able to go back to their homes? Not only are the old land demarcations lost in the undergrowth, but other, newer, threats have emerged; contested land use and ownership, changes in land tenure systems, large scale land grabbing, weakened dispute resolution mechanisms, the encroachment of “game reserves” and demarcation of new district boundaries, as well as the scramble by “investors”.

Our latest short documentary, ‘Shoot Us All Down’, explores how in Lakang and Apaa sub-counties, Amuru District, land has become such a contested issue that people are ready to die over it. It is a conflict seen in terms of powerful stakeholders at odds with ordinary civilians; it is a conflict which highlights what can happen when people lose trust in the governance structures. At current levels, the land conflicts serve as an early warning to all those concerned with the the re-establishment of state authority and the wider achievement of reconstruction and sustainable peace in Uganda.

This co-edited monograph by 3R Chairperson Jeff Handmaker with colleagues Jackie Dugard and Jonathan Klaaren at the University of the Witswatersrand was published as a special issue of the South African Journal on Human Rights.

The publication, which devotes considerable attention to litigation strategies on behalf of asylum seekers and refugees, consists of an introduction, six fully-fledged articles, four current developments or case notes and a number of related book reviews and incorporates both scholarly and practitioner-oriented perspectives.

The entire monograph / special issue is fully-available as an open access publication, thanks to an agreement between the publishers (Juta) and the Editorial Board of the South African Journal on Human Rights.

Police on Tuesday arrested six Tibetans for illegally sneaking into Nepal from Chinese administered Tibet.

The six fleeing Tibetans are said to be males between 20 to 30-years-old. They had entered Nepal from Lamabagar of Dolakha district, which shares border with Tibet, and managed to reach Singati Bazaar unnoticed through six police posts before being arrested by a police team from Area Police Office, Singati.

The identities of the six arrested Tibetan men are yet to be ascertained as they were traveling with no travel documents, police said.

They are currently being kept at District Police Office, Charikot and would later be handed over to the Immigration authorities for investigation and to decide whether they should be handed over to the UN refugee or Chinese authorities.

Hundreds of Tibetans risk their lives by making dangerous journey across the mountainous border into Nepal every year. Upon China’s request, Nepal has beefed security along its border with Tibet making it hard for Tibetans to escape.

In January this year, police had arrested nine Tibetans from Sindhupalchowk district near its border with Tibet as they were entering the country.

This edition of DevISSues is devoted to perspectives from development practitioners, revealing certain opportunities and constraints faced by civic advocates in advocating for the realization of human rights and social justice. Accordingly, this edition presented a personal challenge for me, having researched the capacity of civic actors to hold states accountable to their human rights obligations. This led me to ask the question: can a deeper and more critical understanding of civic efforts to mobilize social justice be helpful to practitioners, operating in the real world? Turning the question around: can social justice advocates, and the donors and solidarity groups that support them, be more strategic in evaluating the potential of their interventions, or in extending solidarity and support to locally-based groups?

To engage with these questions, seven papers were commissioned from social justice practitioners who have a long experience and a critical perspective, and are therefore well positioned to engage with these questions.
