Dr. Jeff Handmaker, Board member of the 3R Foundation and lecturer in law, human rights and development at the Institute of Social Studies (ISS) of Erasmus University in The Hague, visited the Helsinki Citizens Assembly (HCA) in Istanbul, Turkey from 5 to 6 July 2010, where he gave workshops for the refugee programme of HCA, reflecting on his earlier experiences with, and research on refugee rights advocacy in South Africa.

The interactive and critical exchanges that took place with HCA legal officers, legal fellows and interns focussed on the dynamics between different NGOs and other civic organisations, including migrant/refugee-led groups, and the interactions between civic organisations and the government as well as UNHCR.

Refugees & asylum seekers now have free access to the internet and can also use the computers to prepare their documents.

Advisory Committee

An Advisory Committee was recently formed to act as an advisory body to PPR Nepal on matters related to refugee rights and refugee legal aid. PPR Nepal has already started to document incidents of refugee rights violations and is currently providing legal servicces and psychosocial services to refugees in Nepal. PPR Nepal would like to thank to 3R Foundation for their cooperation in this regard and welcomes any cooperation, suggestions and sharing of experiences in this regard.

The Committee will work towards the promotion and protection of refugee rights in Nepal.  Composition of the Committee is as follows:

The Turkish NGO Helsinki Citizens’ Assembly is trying to safeguard their rights, offering them such things as legal counseling and information. The organization is also trying to influence public opinion and to spotlight the refugees’ difficult situation.

One way of reaching other organizations, government agencies and the general public is via the journal Refugee Voices, in which people tell what life as a refugee is like in Turkey. The journal appears only sporadically because it cannot always afford the printing costs.

With a view to improving the journal’s design and publishing approach, Daniel Urey, and Erik Engren from International Media Network Services, have been cooperating with the Helsinki Citizens’ Assembly.

Refugee Voices – behind the scenes

A group of young refugees who arrived in Turkey unaccompanied have also taken part in the work. They began by joining workshops focusing both on the Convention on the Rights of the Child and on perceptions of human rights in Turkey, and have subsequently been involved in the magazine work.

“These young people haven’t simply been interviewees – they have been behind the camera and produced material,” Urey says. “They’ve been incredibly dedicated and it’s been great to see how keen they’ve been to express themselves.”

As a result of the project the last issue of  “Refugee Voices” can now be downloaded as a PDF file with both text and moving images.”

Marieke van Eik

Marieke van Eik, advocaat bij Böhler Franken Koppe Wijngaarden advocaten, vertrok voor twee dagen naar Istanboel om training te geven aan Helsinki Citizens’Assembly.

De training was georganiseerd in kader van het Matra project ‘Legal Protection and Advocacy for Refugees in Turkey’.

Helsinki Citizens’ Assembly Turkije heeft samen met Refuge Asylum & Migration een rapport gepubliceerd over de positie van LGBT vluchtelingen in Turkije.

Unsafe Haven: The Security Challenges Facing Lesbian, Gay, Bisexual and Transgender Asylum Seekers and Refugees in Turkey – July 09

Het rapport is gebaseerd op 46 diepte-interviews met LGBT-asielzoekers en vluchtelingen. De meeste vluchtelingen komen uit Iran. Hun getuigenissen werpen licht op ernstige gebreken in hun bescherming. Er is sprake van gewelddadige intimidatie door de lokale gemeenschap en andere vluchtelingen, een gebrek aan voldoende politiebescherming, een intensieve ondervraging tijdens de asielprocedure en belemmering bij het vinden van huisvesting, werk en onderwijs. In het rapport worden een aantal praktische aanbevelingen gedaan om te komen tot een goede bescherming van LGBT-asielzoekers en vluchtelingen en te zorgen voor gelijke sociale en economische rechten.

Turkije heeft geen asielwetgeving. Het land is wel partner in het Verdrag van Geneve, maar heeft een uitzonderingsclausule. Gevolg is dat het land alleen asielzoekers opneemt als ze uit Europa komen. Dit lijkt vreemd, maar komt doordat het verdrag tot stand is gekomen vlak na de Tweede Wereldoorlog.  Turkije bood toen onderdak aan vluchtelingen uit Europa. Tegenwoordig gebruiken veel vluchtelingen uit Irak, Iran, Afghanistan en Somalië Turkije als doorgangsland. Asielprocedures lopen via de UNHCR die een vertegenwoordiging heeft in Ankara, maar de procedure duurt lang,  is ingewikkeld en onzeker. Hetzelfde geldt  voor de procedure voor tijdelijk asiel in Turkije. Eén van de problemen is dat er te weinig rechtshulpverleners zijn om de vraag aan juridische bijstand te kunnen voldoen.

Het doel van het project is de juridische bescherming van asielzoekers en vluchtelingen in Turkije te versterken. Door middel van een train-de-trainers programma worden zowel bestaande als nieuwe asieladvocaten opgeleid en gecoacht. Deze advocaten adviseren en vertegenwoordigen asielzoekers en vluchtelingen bij de UNHCR en het ministerie van Binnenlandse Zaken. Tenslotte wordt er door een werkgroep gewerkt aan een witboek inzake een uitgebreid publiek systeem op het gebied van rechtshulpverlening aan vluchtelingen.  In Nederland opgedane kennis en ervaring wordt gebruikt bij het opzetten van het train-de-trainers programma en het ontwikkelen van het witboek.

Stichting 3R werkt binnen dit project samen met het Helsinki Citizens’Assembly in Turkije. HCA-Turkije is verantwoordelijk voor de uitvoering van het project in Turkije. Stichting 3R zorgt voor de Nederlandse expertise.

Het project wordt financieel ondersteund door het Matra Programma van het ministerie van Buitenlandse Zaken.
